MOUNT AIR CONSERVANCY

POLICY RESOLUTION NO. 4

PARKING AND TOWING

        WHEREAS, Article VI, Section 6(d), of the Declaratioon ("Declaration") of Mount Air Conservancy ("Association") prohibits the parking of certain vehicles within Mount Air Conservancy;

        WHEREAS, Article VI, Section 9, of the Declaration provides for the regulation of parking on common areas by the Board of Directors;

        WHEREAS, Article VII, Section 1(a), of the Bylaws of Mount Air Conservancy provides that the Board of Directors shall have the power to adopt and publish rules and regulations governing the use of the Common Area and facilities, and the personal conduct of the members and their guest thereon, and to establish penalties for the infraction thereof;

        NOW, THEREFORE, IT IS HEREBY RESOLVED that the Board of Directors adopts the following parking procedures:

            The parking rules pertain to the Village of Mount Air and streets maintained by Mount Air Conservancy. These include Enochs Drive, Kernon Court, Shirley Woods Court, Mockingbird Woods Court, Bluebird Woods Court, Cardinal Woods Court and Redbird Woods Court.

            Mount Air Drive is State-owned; use of that street is governed by the laws of the Commonwealth of Virginia.

            Vehicles parked in violation of parking rules and regulation will be towed at the owner's sole risk and expense.

            Each owner/resident expressly agrees that if he or any member of his family, tenants, guest or licensees shall illegally park or abandon any vehicle referred to in the parking policy, he will hold the Board of Directors harmless for any and all damages or losses that may ensue, and expressly waives any and all rights, notices and resources in connection therewith that them may have under the provision of State or County ordinances.

            Parking is authorized only in designated parking spaces. No parking is permitted on the lawn areas of the community or in designated fire lanes ( marked by signs and/or yellow painted curbs). For safety reasons, no double parking of cars will be permitted on Association owned streets.

                    A. Parking areas are for authorized motor vehicles only. Automobiles must have current license plates, current inspection and current county decals and be in operating condition.

                    B. Any vehicle not parked within the boundaries of one parking space may be towed without notice.

                    C. Any vehicle parked in a fire lane may be towed without notice.

                    D. Pickup trucks must meet the following conditions:

                                1. Capacity rating must be less than 1 ton

                    E. Except for occasional commercial vehicles performing deliveries or services in the community, the following are prohibited in Mount Air parking spaces; vehicles over one ton load capacity, trailers, campers, boats and motor homes.

                    F. Minor repairs (Flat tire, dead battery) which can be completed within 24 hours are permitted.

                    G. Any vehicle which has a flat tire or appears to be inoperable shall be tagged with a parking violation notice. If the vehicle is not repaired or moved with 7 days of this notice, it may be towed.

                    H. The parking lot at the tennis courts is exclusively reserved for people using the tennis facilities and overflow resident parking. The parking of commercial vehicles, trucks, trailers, campers, boats and motor homes is expressly prohibited. Any vehicle parked in violation of this rule may be towed without notice.

                    I. The Association Board of Directors and their management agent are authorized to tow vehicles wrongfully parked in any area within Mount Air.

                    J. The Association is not responsible for damages done to any vehicle parked in the community.

                    K. The Association is not responsible for damages that result from actions taken by a resident.

                    L. The resolution is effective March 1, 1992.
